Property Tax Lien doesn't mean you can't sell your home. 

If you have a lien on property you should not ignore the IRS.  This is not a bill you can just wish away.  The end result of a property tax lien can mean lossing your home.   IRS Commissioner Douglas Shulman wants to expediate the process it's using to deal with residential tax liens.  They hope by doing this, it will enable many homeowners to keep their homes. 

When a homeowner is faced with tax trouble they are allowed to request that the federal tax lien be made secondary to the loan's lender.  This lien subordination makes the lender more willing to provide a loan, since they are listed as first priority. Shulman knows speeding up that subordination process could save many homeowners from lossing their property.

For those with property tax problems and considering selling your home for less than the existing mortgage, the IRS can also discharge the tax lien.  They are making every effort to avoid getting in the way of  homeowners trying to refinance or sell their home.  This has been available and currently taking up to 30 days.  Be clear with your lender on the property tax help your seeking, they may even know of some state programs that could help you.

Submit Request: Type a letter of request and documentation to One of the Collection Advisory Groups listed on the bottom of their page.  Form 4235

In these difficult economic time the government  is constantly adding new programs to aid homeowners.  Never forget to contact your State Representative for any program you may currently qualify for.   Representative

While a Tax Lien discharge sounds like you are debt free, think again.  They are only releasing their claim on the taxpayer's home to make refinancing or selling possible.  You will still be responsible for the taxes that are due.

 
 A Notice of lien on property will be issued only if they can not contact you.  Please don't ignore them,  you may be able to avoid doing all the work listed above.   If they remove a tax lien on a residence for what ever reason, they can shift claim on that taxpayers' other assests.

If you considering a modification on your loan or short sale, you should get a hardship letter prepared.

Hardship Letters need to be to the point, truthful while convincing lender to stop foreclosure or accept the plan your presenting.  Don't threaten, complain or blaim just present a possible solution.  Show legitimate reason for falling behind. Banks usually hands these over to a loss mitigator who receives so many.

Step 4:  State the Work Out Plan you are seeking.  Example Short sale, modification on loan, repayment.

Step 5:  Explain financial hardship example: Job Loss, Illness, Family death, divorce, health insurance,  Adustable mortgage, business failure, unexpected expenses.

Step 6: Explain why this caused you to fall behind & why you can't comply to the original terms. If you feel you will be able to later, you may want to have a modification on terms till your situation improves.  

Step 7: Explain a plan of payments to get back on track.  This plan must be possible based on your income.  If short sale is your goal than you should know what to expect from you home sale.  I can help you with a Short Sale.

Define identity theft is knowing when someone uses your personal information, without your permission, to commit fraud or other crimes, it's theft.. They can charge many items in your name, a credit card, a telephone account, rent, food and it goes on.

Knowing How stolen identity happens will help protect you.

Methods used to get your Information:
1.) Going through the trash for your personal information
2.) A Dishonest Mail Carrier gets your information - Report to FBI
3.) While Processing your Card they use a special storage device
4.) Claim to need updates on your information through emails, phone or mail
5.) They divert your billing statements to another location by completing a change of address form.
6.) They steal your mail with pre-approved credit offers or steal your wallets/ purse.

Stolen identity can happen to any one of us.  Some companies have identity theft programs already in place for their customers.  Metlife, Citigroup and Washington Mutural are a few offering free protectiion. 

Identity Theft Protection
1.)  Only carry what you need with you
2.)  If your mail security is questionable get a P.O Box
3.)  Never give any personal information out unless you called them using the phone number on your accounts
4.)  Never answer Information Update notices- email, phone, mail
5.)  Don't use passwords that are easy, like birth date, house number or name
6.)  Never carry Social Security Card with you
7.)  Distroy all personal paperwork
8.)  Use Credit Cards at safe sites and safe businesses only

Signs of Stolen Identity
1.)  Credit Card charges aren't from you- check often
2.)  Bill collectors notice on something that isn't yours
3.)  Credit History has bad marks
4.)  Rent Notice from someone unknown
5.)  Job information where you never worked
6.)  Warrent for your arrest for missing court date you knew nothing about
7.)  Tax Return says you already filed
8.)  Accounts of any kind that you know nothing about

How to figure your DTI

How to figure your DTI ratio!

Calculate your Debt to Income Ratio (DTI) so the lender & you have a better idea of what you can afford or if you qualify for loan modification.  Convential Loans were typically set at 29/36 & FHA loans at 33/43. The front end ration represents your Mortgage, Insurance & taxes. The back end represents your total recurring monthly debt. Many lenders show a higher DTI number closer to 33/38.

Formula for DTI Ratio

Example of DTI 33/38 with Gross Income of $50,000.00 year
Yearly Gross Income = $50,000 / Divided by 12 = $4166.00 per month income.
$4166.00 Monthly Income x .33 = $1,374.78 allowed for Mortgage Expense.
$4166.00 Monthly Income x .38 = $1583.08 allowed for Recurring Debt.

If you make $50,000.00 a year you would qualify for a house payment w/taxes, insurance of $1364.78 a month.  When recurring debt is at 38% which is $1583.00 a month. 

Why you need to know your DTI ratio

Every lender uses this method to determine how much you can afford on a home mortgage.  This is also used for those seeking loan modification and refinancing. Although each lender may allow a higher or lower percentage, they still want to know you have the income to make the payment at the rate they have set. 

I already have a home, why do I need to know my DTI ratio?

Do the DTI Ratio at 33/38 and if you clearing fall short of the allowed Mortgage Expense (33%) you will be an excellent candidate for mortgage debt relief by negotiating a loan modification.  There are many lenders that have programs in place to help homeowners refinance or modify the loan, even those homeowners underwater. 
Your income will have to justify the new monthly payment at the banks rate of (ex.) 33% or you will be denied.  See some examples of the ways lenders can lower your monthly payment at Hud.  The banks are being offered government incentives now to refinance qualifing borrowers.  Contact your bank to see if they have any programs in place to help you and if not, see Hud free counceling services to get a local advisor, they may be able to find you a bank that will refinance your loan under these new programs.
